GENERAL TERMS AND CONDITIONS OF SALE (T&Cs)

1. Seller
These Terms and Conditions of Sale apply to orders placed on lesfleursdavalys.com withAVALYS, a French limited liability company (SARL) with a share capital of €7,500, registered with the Nanterre Trade and Companies Register (RCS) 508 000 171, SIRET 508 000 171 00019, VAT Number FR60 508 000 171, 5 rue de Longchamp, 92200 Neuilly-sur-Seine. Contact : +33 6 19 51 56 51 — lesfleursdavalys@gmail.com. The customer accepts these Terms and Conditions of Sale before confirming their order.
2. Products
AVALYS sells bouquets, floral arrangements, plants, and related products. The essential characteristics and prices are displayed on the website. As flowers are natural and seasonal products, slight differences from the photographs may occur. In the event of unavailability, secondary flowers or foliage may be substituted with elements of equivalent or higher quality and value, without altering the essential characteristics of the arrangement. AVALYS will contact the customer regarding any significant changes.
3. Prices, Orders, and Payment
Prices are displayed in euros, inclusive of all taxes (VAT included). Any applicable delivery fees are specified before payment. The customer must verify the products, recipient’s contact details, delivery address, and selected date and time slot. Payment is made using the methods offered on the website, including via Stripe. The order is confirmed once it has been validated and payment has been accepted. The customer receives confirmation on a durable medium, particularly by email. AVALYS may refuse an order for a legitimate reason, including in cases of fraud or non-payment.
4. Delivery and Pickup
In-store pickup is free of charge. Delivery is available within the areas and time slots indicated on the website. A delivery time slot does not guarantee an exact arrival time. For eligible products and subject to availability, an order placed before 3:00 PM may be delivered on the same day. For Sunday delivery, the order must be placed no later than the previous day. Certain products require additional preparation time, which is specified when placing the order. The customer’s statutory rights in the event of delayed or failed delivery remain applicable.
5. Delivery Fees
Delivery fees are displayed before order confirmation: Neuilly-sur-Seine 6 € ; Courbevoie 8 € ; Puteaux, Levallois-Perret, Boulogne-Billancourt et Paris 8e, 16e et 17e : 10 €Delivery fees are displayed before order confirmation: €30 worth of products per delivery.
Free delivery is available for product orders of €150 or more (including VAT) for a single delivery to one address, on the same date and within the same delivery time slot. If the shopping cart includes multiple deliveries (different addresses, dates, or time slots), the €150 threshold is calculated separately for each delivery. The exact delivery fees are displayed before final order confirmation.
6. Unsuccessful Delivery
The customer must provide accurate contact details and ensure that the recipient is available to receive the order. In the event of the recipient’s absence or an incorrect address, AVALYS will seek a solution with the customer whenever possible. An additional delivery fee may be charged for a new delivery attempt, provided the customer has been informed in advance. The customer’s statutory rights remain applicable.
7. Cancellation and Right of Withdrawal
Any cancellation request must be submitted to AVALYS as soon as possible. Once the preparation of a floral arrangement has begun, cancellation cannot be guaranteed, subject to the customer’s statutory rights.
In accordance with Article Article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to fresh flowers and other goods that are liable to deteriorate or expire rapidly, nor to goods genuinely made to the consumer’s specifications or clearly personalized, under the conditions provided for by law.
For other products legally eligible for withdrawal, the consumer has a right of withdrawal of 14 days from the date of receipt, in accordance with the applicable legal provisions. The consumer may notify AVALYS of their decision at lesfleursdavalys@gmail.com or use the standard withdrawal form below. For these products only, the customer has 14 days from receipt to notify AVALYS of their decision to withdraw, followed by a further 14 days to return the product. The customer is responsible for the direct cost of returning the product, unless otherwise provided by law. AVALYS will refund the amounts due in accordance with the law and may defer reimbursement until the goods have been recovered or proof of their return shipment has been provided, subject to the applicable legal conditions. The customer may use the standard withdrawal form below but is not required to do so.
8. Complaints and Warranties
Any complaint may be submitted to lesfleursdavalys@gmail.com, together with the order number and, where relevant, photographs. Applicable statutory warranties, including the legal guarantee of conformity and the warranty against hidden defects, remain fully applicable. The condition of flowers and plants is assessed in light of their nature and normal storage and care conditions.
9. Liability
AVALYS shall not be held liable for consequences directly attributable to inaccurate information provided by the customer or to an event of force majeure as defined under French law. This clause does not limit consumers’ mandatory statutory rights.
10. Personal Data and Website Content
Personal data is processed in accordance with the Privacy Policy published on the website. The texts, photographs, logos, and other website content are protected by applicable intellectual property laws.
11. Mediation and Applicable Law
The customer may submit any complaint to AVALYS. In the event of an unresolved dispute, the consumer may refer the matter free of charge to the competent consumer mediator: CM2C — 49 rue de Ponthieu, 75008 Paris — www.cm2c.net, subject to the statutory admissibility requirements. The consumer may submit their mediation request via www.cm2c.net.
These Terms and Conditions of Sale are governed by French law, subject to applicable mandatory legal provisions. The applicable version is the one accepted at the time the order is placed. In the event of any discrepancy between translations, the French version shall prevail, subject to mandatory legal provisions.
